By using our site, you agree that you accept these General Terms and Conditions which are applicable to all orders placed through Gourmetdash.com. Please read these terms carefully before using our website or placing an order. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, then you may not access the website or use any services.   

 

1. Definitions   

 

  • "Site" refers to the Gourmetdash.com website.
  • "We", "Us", or "Our" refers to Gourmetdash.com, operated by GFI Foods.
  • "You" or "Customer" refers to the individual or entity placing an order through our Site.
  • "Products" refers to the specialty gourmet items offered for sale on our Site.
  • "Order" refers to your selection of Products and submission of payment to purchase them through our Site.

2. Use of the Site

  • You must be at least 18 years of age to use our Site and place orders. By using our Site, you represent and warrant that you are at least 18 years of age.
  • You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.   
  • You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.   

3. Orders and Payment

  • Orders can be placed 24 hours a day, seven days a week via our website.
  • We are available to answer questions and assist with orders during our normal office hours Monday - Friday from 9:00 am - 5:00 pm eastern time at 470-925-1220.
  • Payment types accepted on our site include all major credit cards, PayPal, Venmo, Apple Pay and Google Pay.
  • By submitting an order, you warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees).   
  • If you have any problems completing an order, please call us at 470-925-1220 and we will be glad to assist! Outside of business hours please send us an email at gourmetdashcsr@gfifoods.com  and we will get back to you as soon as possible.
  • All prices displayed on the Site are in U.S. Dollars and are subject to change without notice.
  • Sales tax will be applied to your order where required by law.

4. Product Information and Availability

  • We make every effort to display our Products accurately, including their descriptions, images, and nutritional information. However, the actual colors and details you see on your screen may depend on your monitor and may not be entirely accurate.
  • Due to the fact that the specialty gourmet products that we stock are hard to find, unique items, there is sometimes limited availability and irregular deliveries from our suppliers.
  • Despite our best efforts, occasionally some Products will not be available on the expected ship date.
  • To get you the rest of your order as soon as possible, we will ship the Products we have on hand and refund you for the items that were unavailable. If you had only one item in your order, your order will be canceled. In both cases, you will be notified by a member of our Customer Service Team.
  • For our collections and assortments, if we are short an item in the collection, we will ship an appropriate substitution of equal or greater value. We will make reasonable efforts to notify you of any substitutions before shipment.

5. Order Fulfillment and Shipping

  • All orders placed before 11:59 PM PST will ship on the next available shipping day. We ship Monday-Thursday; Friday is available to ship non-perishables and overnight orders.
  • Shipping costs are calculated based on the weight of your order, the destination, and the shipping method you select. These costs will be displayed at checkout before you complete your purchase.
  • You will receive an order confirmation email showing order details and a shipping confirmation email showing tracking information once your order has shipped.
  • Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers or unforeseen circumstances.   
  • Risk of loss and title for Products purchased from the Site pass to you upon our delivery to the carrier. You are responsible for filing any claims with the carrier for lost or damaged shipments.   

6. Address Change or Incorrect Address

  • Upon placing your order, an order confirmation is sent to the email address you provide. The email order confirmation includes the shipping and billing address.
  • If you notice you have mistakenly entered incorrect shipping address information, please contact us immediately at 470-925-1220 or via email at gourmetdashcsr@gfifoods.com. We will do our best to update the address before shipment. However, we cannot guarantee that we will be able to make the change.

7. Order Cancellation and Modification

  • While we will always do our best to accommodate requests, once your order has been packed and shipped, we are not able to cancel or modify it.
  • Orders that are already in transit are not able to be rerouted, so please be sure your shipping address is correct when you place your order.

8. Returns and Refunds

  • Unfortunately, due to the nature of our Products, we are not able to accept returns of perishable items or vulnerable non-perishable items, like crackers, cookies, or soft-packaged items.
  • We are only able to accept the return of canned or hard-packaged food items under specific circumstances.
  • If you have a problem with an order or need to request a return of an eligible item, claims must be made within 2 business days of receiving the product. Please contact us at gourmetdashcsr@gfifoods.com for assistance and instructions.
  • For eligible returns, the item must be unopened, unused, and in its original packaging. You will be responsible for the return shipping costs unless the return is due to our error (e.g., we sent you the wrong item).
  • Upon receipt and inspection of the returned item, we will process your refund. Refunds will be issued to the original payment method used for the purchase. Please allow 5-10 business days for the refund to appear in your account.   

9. Defective or Damaged Merchandise

  • We work very hard to assure your order is received intact and in proper condition. However, we understand that sometimes things happen and items can get damaged in transit.
  • If you receive a defective or damaged product, please contact us immediately, but no later than 48 hours of receiving the product. Please do not throw away or discard any items, as we may need information about the item for claim purposes.
  • The easiest way to help us resolve any defective or damaged merchandise issue is to take a picture of the item and email it to us at gourmetdashcsr@gfifoods.com or call us at 470-925-1220. We may request additional information or require the damaged item to be returned.
  • Depending on the situation, we will offer a replacement, a partial refund, or a full refund for defective or damaged merchandise.

10. Intellectual Property

  • All content on this Site, including but not limited to text, images, logos, graphics, button icons, audio clips, digital downloads, and data compilations, is the property of Gourmetdash.com or its content suppliers and is protected by United States and international copyright laws.   
  • You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our Site or any portion thereof for any commercial purpose without our express written consent.   

11. Disclaimer of Warranties

  • To the fullest extent permissible by applicable law, Gourmetdash.com disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.   
  • We do not warrant that the Site, its servers, or email sent from Gourmetdash.com are free of viruses or other harmful components.
  • We will not be liable for any damages of any kind arising from the use of this Site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.   

12. Limitation of Liability

  • To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or relating to your use of the Site or any Products purchased through the Site shall not exceed the total amount you paid for the Products in the applicable order.   
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.   

13. Privacy Policy

  • Your use of our Site is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by this reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.   

14. Governing Law and Dispute Resolution

  • These General Terms and Conditions are governed exclusively by the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
  • Any dispute relating in any way to your visit to our Site or to Products you purchase through us shall be submitted to confidential arbitration in the State of Georgia, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of Georgia, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.   

15. Invalidity - Force Majeure - Applicable Law - Competent Courts

  • If any one of the clauses of these General Terms and Conditions is, for whatever reason, declared invalid or unenforceable, this will not affect the application or the validity of the other clauses. The clause declared invalid or unenforceable will be replaced by a provision that is valid and enforceable and that comes closest to expressing the intention of the original provision.
  • Neither Gourmetdash.com nor the Customer will be held liable for any failure to perform their obligations as a result of a force majeure beyond their control, including but not limited to the following: war, riot, insurrection, interruption of transport systems, problems relating to export and import, strikes, lock-out, shortage of Products, fire, earthquakes, storms, or floods.
  • These General Terms and Conditions are governed exclusively by the laws of the United States and the State of Georgia.
  • All litigation or disputes between the parties shall be brought only before the competent courts in the State of Georgia, United States.

Product Availability

Order Cancellation and Modification

Order changes for Cakes, Pies and Cheesecakes, Caviar, Steaks and Burgers

All cakes, pies and cheesecakes are baked to order and will be shipped separately straight from the bakery to you.  Caviar, Steaks and Burgers are also fulfilled by an outside partner. Because of this, if you need to cancel or make a change to your order including one of these items, please contact us as soon as possible. Once we have processed your order and it has been forwarded to the bakery or our supplier partners we will not be able to offer a refund.

Returns

Unfortunately, we are not able to accept returns of perishable items or vulnerable non-perishable items, like crackers, cookies, or soft packaged items.
